Cancer Misdiagnosis

Cancer misdiagnosis occurs when either a patient who does not have cancer is diagnosed as suffering from cancer and needlessly receives treatment as a result and also in a situation where a patient who may have the symptoms and clinical signs for cancer is not diagnosed in time and the necessary treatment is delayed as a result. Where there has been a delay in providing a cancer diagnosis this can result in a patient having reduced options available to them in terms of their treatment. In many cases the delay will have a detrimental effect on the health and wellbeing of the patient and also an adverse effect on their family. Where there has been a delay in providing a diagnosis of cancer a patient can suffer a loss of opportunity to make a good recovery because of the delay. This may mean that the chances of achieving a successful outcome from the treatment has been significantly reduced. In addition a patient who has suffered a delay in cancer diagnosis may often require more aggressive treatment due to the delay in correctly diagnosing cancer. This may result in surgery that may otherwise have not been necessary and undergoing radiotherapy and chemotherapy which could otherwise have been of less intensity, less duration or not required at all.

Bringing a case for cancer misdiagnosis differs completely from claims dealt with by the Personal Injuries Assessment Board. The Personal Injuries Assessment Board do not review medical negligence claims and therefore those claims must be brought before the Court if an early settlement is not achieved.
